Welcome to the #10YearsOfBorderlands PosterSpy Creative Brief.

To celebrate 10 years of Borderlands and the release of Borderlands 3 on 13 September, PosterSpy is inviting it’s UK based members to create a poster inspired by this iconic franchise.

Winners will be chosen by 2K UK and be displayed in an art exhibition at a Borderlands 3 preview event in London in July 2019.

This Creative Brief is open exclusively to UK based members.

 

The Story

At the hard edge of the galaxy lies a group of planets ruthlessly exploited by militarized corporations. Brimming with loot and violence, this is your home – the Borderlands. 

Step into a universe that combines thrilling action of a first-person shooter with the rich lore and epic loot of a role-playing game. An epic space western, Borderlands is the ultimate shooter-looter, famed for its millions of guns, outrageous humour, and iconic Vault Hunters.

 

Design Tips

We are looking for artwork that celebrates the legacy of the franchise, the striking and bold characters and unique art style. Borderlands is renowned for its captivating visuals and original design. We invite artists, designers and illustrators alike to unleash your artistic imagination and creative tendencies to celebrate the 10 Year Anniversary by pouring your passion for these titles into your artwork.

Five winners will receive cash prizes, with a further 10 being chosen to be exhibited in the exclusive art exhibition. Winners will be judged on creativity, originality, quality and relevance to the Brief.

Guidelines

Create your artwork at A2 (4960 x 7016 pixels), portrait, 300dpi minimum. PSD or Ai.

Titles and logos are not required but can be used if desired.

Artwork submitted must be 100% your own original content. Do not use any images you don’t have the rights to.

This brief is moderated and only entries that follow the T&Cs will be accepted.

 

The Awards

1st, 2nd, 3rd prizes of £1,000 each.

4th, 5th prizes of £500 each.

1st to 15th place all being exhibited in London at a game preview event.

 

How to Enter

Create a free account and upload your artwork via our submission form. Entries uploaded should be a low resolution version of your poster, around 1500 pixels wide, 5MB in size and in JPEG or PNG formats. 

Artists will also need to send their A2 hi-resolution (300dpi) PSD/Ai file to borderlands@posterspy.com via WeTransfer. WeTransfer is a free and secure service. Once the winners are chosen, all hi-res files will be removed from our secure servers.

Entrants must reside in the United Kingdom.

 

FAQ’s

How many submissions can I upload?

You may upload as many submissions as you like, there’s no cap.

Do I keep the rights to my art?

When submitting, you allow 2K and PosterSpy to share your work on social media to promote the campaign. Winning entries consent to having their artwork featured in the UK marketing campaign for the release of. 2K will not use any of the artwork commercially without the artists permission.

Can I sell prints of my submission?

Legally, you are NOT allowed to sell prints that use another company’s intellectual property.

If I win, how long does it take for me to get my prize money?

Typically 8-12 weeks. This can be much shorter or longer depending on when we receive your information.

  1. Introduction
    1. The promoter of this 10 Years of Borderlands Poster Contest (“Contest)” is Take-Two Interactive Software Europe Limited t/a 2K Games, a company registered in England and Wales (company number: 02739756) with its registered office at Hanover House, 14 Hanover Square, London, W1S 1HP, United Kingdom (“2K”).  All questions regarding this Contest should be directed to 2K at the following addresses:

    1. The Contest promotional materials, including information on how to enter this Contest, form part of these terms and conditions. Entry into this Contest is deemed acceptance of these terms and conditions (“Contest Terms”).
  1. Contest Period
    1. Contestants may enter the Contest between May 28th, 2019 at 00:00:01 (BST) until July 3rd, 2019 at 23:59:59 (BST) (inclusive) (“Contest Period”). 2K reserves the right to alter the Contest Period (if in 2K’s opinion it is necessary) at any time without notice prior to the end of the Contest Period. 
  1. How to Enter
    1. The Contest is free to enter and is open only to residents of the United Kingdom aged 18 years or over. 2K, Posterspy Limited (“PosterSpy”), and their respective employees and their immediate families, participating agents and their associated companies are ineligible to enter. 2K reserves the right to verify the eligibility of contestants.
    1. To enter the Contest, contestants must during the Contest Period: 
      1. have a PosterSpy and WeTransfer account. If a contestant does not have a PosterSpy or WeTransfer account, one can be created by visiting posterspy.com (“Website”) or wetransfer.com. PosterSpy and WeTransfer accounts are free;
      1. create a poster inspired by the reference materials available on the page dedicated to the Contest on the Website (“Contest Site”);  
      1. submit a low-resolution version of their poster (approximately 1,500 pixels wide, 5MB in size) as a .jpeg or .png file via the submission form available on the Contest Site; and
      1. submit a high-resolution version of their poster (A2 sized (approximately 4960 x 7016 pixels), no less than 300dpi, and saved as .psd or .ai files) to borderlands@posterspy.com via WeTransfer.
    1. By submitting a poster to the Contest, each contestant warrants and represents that: (i) they are at least 18 years old and a resident of the United Kingdom; (ii) nothing in their entry shall be offensive, insulting, defamatory, racist or otherwise objectionable, inappropriate or unlawful; and (iii) nothing in their entry shall contravene the Data Protection Act 2018 or any duty of confidence owed by them to any third party. 
    1. All information submitted by a contestant as part of this Contest (including, without limitation, the contestant’s name, email address, and any text contained in the contestant’s poster) shall be collectively referred to herein as the “Submission.” Each contestant’s Submission must comply with the Content Restrictions (as defined in Section 4.1 below), as determined by 2K in its sole and absolute discretion.  
    1. 2K is not responsible for any lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled Submissions, which will be disqualified, or for problems of any kind whether mechanical, human or electronic. Only fully completed Submissions are eligible.  Proof of Submission will not be deemed to be proof of receipt by 2K. 2K reserves the right to void any suspicious Submission.
    1. All Submissions successfully received by 2K during the Contest Period, and which comply with the Contest Restrictions, shall qualify for a chance to win the prizes set forth in Section 7 below.    
  1. Content Restrictions
    1. By entering the Contest, each contestant agrees that their Submission conforms to the following content restrictions (“Content Restrictions”) and that 2K, in its sole discretion, may remove any Submission and disqualify a contestant from the Contest if it believes, in its sole discretion, that the contestant’s Submission fails to conform to the Content Restrictions:
      1. the Submission must not contain material that violates or infringes another’s rights, including but not limited to copyright, trademark, privacy, publicity or any other intellectual property rights;
      1. the Submission must not disparage 2K (or any of its affiliates) or any other person or entity;
      1. the Submission must not contain brand names or trademarks of any entity; and
      1. the Submission must not contain material that is racist, offensive, pornographic, vulgar, profane, defamatory, insulting, unlawful, inappropriate or otherwise objectionable.
    1. In the event that any Submission provided by a contestant is incomplete, that Submission will not be accepted. Any Submission sent after the end of the Contest Period will be considered void.
    1. Contestants acknowledge that other contestants may have used ideas and/or concepts in their Submission that may have similarities to ideas or concepts included in contestant’s Submission, and contestants understand and agree that they shall not in any way be entitled to any compensation because of any such similarities. 2K’s decisions are final and binding in all matters relating to this Contest, including interpretation and application of these Contest Terms.
  1. Intellectual Property Rights 
    1. By entering the Contest, each contestant warrants, represents and undertakes the following with respect to their Submission: (a) contestant is the sole and exclusive owner of all aspects of the Submission, apart from any of 2K’s and its licensors’ intellectual property, including copyrights, trademarks, names, logos, designs, artwork, publicity rights (or any analogous rights) and characters owned by or licensed to 2K (collectively, “2K IP”), which may only be used pursuant to the limited license described more fully herein; (b) apart from any included Sponsor IP, the Submission is contestant’s own creation; (c) the Submission will not infringe on any rights of any third party, including but not limited to copyright, trademark, privacy, publicity and/or any other intellectual property right and will not include the name, photo, or likeness of a third party without permission from such third party; (d) the Submission complies with the Content Restrictions; and (e) the Submission has not been submitted previously in a promotion of any kind, won any kind of award and/or been exhibited or displayed publicly through any means.
    1. By submitting a Submission to this Contest, each contestant hereby agrees that their entry may be promoted and/or broadcast on 2K’s website and social media platforms (e.g. Facebook, Instagram, Twitter, YouTube, Tumblr, etc.) and displayed at the Borderlands preview event referenced in Section 7.1 below, and each contestant hereby grants 2K, its licensees, successors and assigns, a non-exclusive, royalty-free, perpetual and irrevocable license to use, reproduce, copy, publish, display, distribute, perform, translate, adapt, create derivative works from and/or modify their entry, in whole or in part, for the purpose of the Contest and the Borderlands preview event.
    1. 2K grants eligible contestants a limited, revocable, non-sublicensable, license to use the Sponsor IP for the sole purpose of creating and submitting the Submission for review and assessment in this Contest. Contestants are not permitted to make any further use of Sponsor IP for any purpose whatsoever. In addition, contestants recognise that all right, title, and interest in Sponsor IP as well as all derivative works created using Sponsor IP shall vest exclusively to the Sponsor or its licensors (as applicable), and each contestant hereby agrees that they have not and will not take any action that might harm or adversely affect such rights. No right, title, or interest in and to the Sponsor IP except for the limited license granted to eligible contestants in these Contest Terms is transferred or created. Each contestant further acknowledges and agrees that Sponsor IP rights are valid and enforceable, and that contestants shall do nothing to challenge the validity or enforceability of Sponsor IP in any forum. Each contestant hereby agrees that the use of Sponsor IP is permitted only for the purpose of making a Submission for entry in this Contest, and that any use of Sponsor IP (whether in the Submission or otherwise) beyond this scope infringes the rights of 2K and/or its licensors and will result in irreparable harm to 2K and/or its licensors. If required by 2K, in its discretion, and without prejudice to 2K’s other potential remedies, contestants will remove their Submission from any and all platforms and ensure it is no longer publicly accessible without delay. FOR THE AOIDANCE OF DOUBT, EACH CONTESTANT HEREBY ACKNOWLEDGES AND AGREES THAT THEY MAY NOT SELL OR OTHERWISE COMMERCIALLY EXPLOIT THEIR SUBMISSION(S) IN ANY WAY WITHOUT 2K’S EXPRESS PRIOR WRITTEN CONSENT.
    1. Each contestant understands and agrees that 2K’s use in matters independently developed of material similar to or identical with the Submission or containing features or elements similar to or identical with those contained in the Submission will not obligate 2K to negotiate with such contestant, nor will it entitle such contestant to any compensation of any kind. Each contestant agrees and acknowledges that nothing herein shall preclude 2K from using any material in or similar to the Submission without any obligation toward such contestant, including, but not limited to, if 2K has an independent legal right to use such other material, including without limitation, because such features or elements were not new or novel, or were not originated by such contestant, or were or may hereafter be independently created by or submitted to 2K.
  1. Winner Selection
    1. On or around July 3rd, 2019, 2K shall review all eligible Submissions successfully received during the Contest Period together with an independent judge determined by 2K in its absolute discretion.  The judging panel will judge all of the eligible Submissions successfully received during the Contest Period in order to determine the fifteen (15) highest scoring Submissions based on the following equally-weighted judging criteria (“Judging Criteria”): (a) creativity; (b) originality; (c) quality; and (d) relevance to the brief set forth on the Contest Site. In the event of a tie, all tied entries will be re-judged by an additional judge selected by Sponsor who will break the tie using the Judging Criteria.  By entering the Contest, contestants fully and unconditionally agree to be bound by the decisions of the judges, which will be final and binding in all matters relating to the Contest. This is a game of skill and chance plays no part in the determination of the winner.
  1. Prizes
    1. Each of the Submissions selected as one of the top fifteen (15) highest scoring Submissions pursuant to Section 6.1 will be exhibited by 2K at a Borderlands 3 Preview event that is due to take place at a location in London to be determined by 2K in its absolute discretion on a date in July 2019 to be determined by 2K in its absolute discretion. The location of the Borderlands 3 Preview event will be announced by 2K in advance of the event. In addition, the contestants responsible for:
      1. the fourth (4th) and fifth (5th) highest scoring Submissions shall each also receive Five Hundred British Pounds Sterling (£500); and
      1. the first (1st), second (2nd), and third (3rd) highest scoring Submissions shall each also receive One Thousand British Pounds Sterling (£1,000). 
    1. The cash prizes set forth in Section 7.1.1 and 7.1.2 shall be paid to each relevant contestant by PosterSpy via bank transfer to the bank account designated by the relevant contestant. Payment shall be made as soon as reasonably practicable after the date on which the Submissions are judged and the top five (5) highest scoring Submissions are determined, subject to PosterSpy’s receipt of the relevant contestant’s bank account details. Payments may take up to twelve (12) weeks to be processed. 
    1. All taxes and unspecified expenses with participating in the Contest and/or accepting any prizes are the responsibility of each contestant. 
  1. Notification
    1. The Contestants responsible for the top fifteen (15) highest scoring Submissions (“Winners”) shall be announced via the Contest Page promptly after they have been determined. Each such contestant shall also be contacted, within forty-eight (48) hours by 2K or PosterSpy via email to the email address that they used to submit their Submission, to confirm that they are one of the winners of the Contest, and to inform them how to claim their prize. 
    1. In the event that: (i) any Winner cannot be contacted or does not respond to 2K’s email within fifteen (15) calendar days of first notification attempt; (ii) any Winner rejects the cash prize awarded to them; or (iii) the Winner has failed to comply with these Contest Terms, that Winner’s prize will be forfeited.
    1. Upon forfeiture of a prize, no compensation will be given. Each Winner’s name may be published on the Contest Page and will be made available on request in writing to 2K using the contact details set out in Section 1.2. Each contestant hereby consents to the publication of their name by 2K in accordance with this Section 8.3. 
  1. Limitation of Liability
    1. Participation in this Contest constitutes the contestant’s permission for 2K to use the contestant’s name, likeness, photograph, picture, portrait, voice, biographical information and/or any statements made by the contestant regarding the Contest or 2K for advertising and promotional purposes without notice or additional compensation, except where prohibited by law. 
    1. By participating in the Contest, each contestant agrees to release and hold harmless 2K and PosterSpy and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors (collectively, the “Released Entities”), from any and all liability, loss, harm, damage, injury, cost or expense whatsoever (other than as expressly set out in Section 9.3 below) which may occur in connection with: (i) their preparation for, travel to, or participation in the Contest; (ii) their possession, acceptance and/or use or misuse of any Finalist Prize or Grand Prizes; (iii) their participation in any Contest-related activity; and/or (iv) any claims based on: (a) any infringement of any publicity or privacy rights; (b) defamation; or (c) any copyright infringement, trademark infringement or other intellectual property-related cause of action.  
    1. Nothing in these Contest Terms shall in any way exclude or limit any of the Released Entities’ liability for any: (a) fraud or fraudulent misrepresentation; (b) death or personal injury caused by its negligence; (c) any other liability to the extent that such liability may not be excluded or limited as a matter of English law. 
    1. 2K reserves the right to cancel or postpone this Contest without liability upon the occurrence of any event or circumstance beyond its control.
    1. 2K may prohibit any contestant from participating in the Contest or winning a prize and/or participating in any future contest or other promotion conducted by 2K if, in its sole discretion, it determines that said contestant is attempting to undermine or has undermined the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices, has violated these Contest Terms, has acted in an unsportsmanlike or disruptive manner, or has annoyed, abused, threatened or harassed any other contestants, or 2K representatives.
    1. CAUTION: ANY ATTEMPT BY A CONTESTANT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, 2K RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH CONTESTANT TO THE FULLEST EXTENT PERMITTED BY LAW.
    1. THE CONTEST AND ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.  
  1. Data Protection
    1. Contestants’ personal data submitted by contestants to this Contest shall be collected, and controlled, by 2K and PosterSpy. 2K and PosterSpy shall be an independent data controller of such personal data and all such personal data shall be processed by each independent data controller, and data processors appointed by such independent data controller, for the purposes of conducting, administering and marketing the Contest. By participating in the Contest, contestants hereby acknowledge that they have read and understood 2K’s and PosterSpy’s respective privacy policies. 2K’s privacy policy is available at www.take2games.com/privacy. 
    1. Each of the Winners also understands that 2K may disclose their name, photo and content of their Submission for the purposes of marketing the Contest in any media or format now or hereafter known, and/or for any other purpose that is compatible with such purposes, in either case without further compensation (financial or otherwise), permission or notification. 
    1. Each contestant understands that 2K has a valid legitimate interest in processing their personal data for the purposes set forth in these Contest Terms.
  1. General
    1. 2K reserves the right, at its sole discretion, to change, modify, add or remove portions of these Contest Terms at any time up to the start of the Contest Period.
    1. If any Section or part of a Section of these Contest Terms is, or becomes, invalid, illegal or unenforceable, then that Section or part thereof shall be deemed to be deleted from these Contest Terms.  Any such deemed deletion shall not affect the validity, legality or enforceability of the remainder of these Contest Terms.
    1. In the event that any contestant breaches these Contest Terms, such contestant shall be automatically disqualified from the Contest and ineligible to win any prize in connection with the Contest.
    1. The Contest is organised under and is subject to English law. These Contest Terms are governed by and construed in accordance with English law and the courts of England and Wales shall have exclusive jurisdiction over any disputes arising out of these Contest Terms.
